Call To Order:

The special meeting of the Building, Planning and Zoning Committee of the Village of Kenilworth in the Kenilworth Village Hall, Kenilworth, Illinois was held at 7:00 p.m. on Thursday, January 11, 2018. Chairperson Winslow called the meeting to order at 7:02 p.m.

Chairperson Winslow opened the meeting.

Agenda Item II. Approval Of The Minutes

The Minutes of the Building, Planning and Zoning Committee Meeting of November 27, 2017 were placed before the members. There were corrections made.

Trustee Kaz made a motion to approve the November 27, 2017 Building, Planning and Zoning Committee Meeting Minutes as amended and Trustee Bedwell seconded the motion. A voice vote was taken and the November 27, 2017 Building, Planning and Zoning Committee Meeting Minutes as amended were approved.

Agenda Item III. Discussion Of Right-Of-Way Regulations

Chairperson Winslow opened the discussion of right-of-way (ROW) regulations and asked Community Development Director Criezis to provide an introduction on the topic and explain proposed revisions for consideration. Ms. Criezis said the Village’s ROW regulations were adopted in 2007 and have not been revised. She said they appear to have been modeled after Winnetka’s ROW regulations that were adopted in 2007. She said staff reviewed the ROW regulations and compared them with Winnetka’s regulations to determine differences. She said the primary differences are that Winnetka requires most utilities to be underground, and there are extensive tree preservation requirements for utility installations both above ground and underground in the ROW.

Trustee Bedwell asked Ms. Criezis to explain her process to review ROW regulations. Ms. Criezis said the ROW regulations for Kenilworth and Winnetka were reviewed page by page to compare language and differences, and then a list of suggested revisions and additions to Kenilworth’s ROW regulations were reviewed with the Village Manger. She said in reviewing ROW regulations, there were references to Kenilworth’s Tree Preservation regulations, but a review of those regulations adopted in 2005 determined that they did not adequately address tree trimming and tree protection during construction activities. She said the regulations focus primarily on tree removal and have few provisions for tree protection during construction. This lead to a comparison with Winnetka’s tree regulations, assembling a list of suggested revisions to Kenilworth’s tree regulations, and review with the Village Manager. Following this, proposed revisions to ROW and Tree Preservation regulations were drafted for review by BPZ.

Ms. Criezis said the primary considerations for revisions to ROW regulations include that there should be no attachment to Village street lights and no pole extensions on street lights. For new utility pole locations, they cannot be within 20 feet of any tree in the parkway, cannot be within the drip line of any protected tree or heritage tree on public or private property, and cannot require removal of trees. She said the regulations should clarify preference for underground utilities, instead of above ground installations. She said trees and vegetation requirements should address tree trimming, have references to protected trees and heritage trees in Tree Preservation regulations, and require screening of above ground utilities. She said legal was checking on whether the installation of new poles could be prohibited in the parkway.

Ms. Criezis said the primary considerations for revisions to Tree Preservation regulations are to revise tree protection plan requirements, and add tree protection procedures prior to construction, during construction, and following construction.

Ms. Criezis reviewed each of the proposed revisions to ROW and tree regulations. Trustee Kaz said she wanted revisions to Section 56.15(H)(3) Facilities Installed Above Ground to add the words: “Existing utility poles and traffic standards shall be used wherever practicable in non-residential districts; the installation of additional utility poles is strongly discouraged.” She said she does not want existing poles to be used in residential areas. Trustee Bedwell discussed Section 56.16(A)(2)(c) Drip Line of Trees and suggested the language “The utility shall not trench or create bore pits within the drip line of any tree.” should be revised. He suggested the word “excavate” or another broader term be added and asked what a bore pit was. Ms. Criezis said she would research this term. There was general discussion of trees that the Village had planted in parkways and had not survived.

The Trustees unanimously agreed with the proposed revisions to ROW and Tree Preservation regulations as discussed, and directed staff to work with legal to prepare an ordinance amending the regulations. Chairperson Winslow said she would like the draft ordinance to be discussed at the next BPZ meeting and then brought to the Village Board for adoption. She suggested that the next BPZ meeting date be February 12 at 6:00 p.m., prior to the Village Board meeting on that day at 7:30 p.m. She said she would like the draft ordinance to be considered for adoption by the Village Board on February 12. The other Trustees agreed with this schedule.

Ms. Winslow suggested that after staff and legal had drafted the ordinance, it should be reviewed individually by the BPZ members prior to the February 12 BPZ meeting. She said comments could be received by staff and revisions made to the draft ordinance.

Trustee Kaz made a motion to adjourn and Trustee Bedwell seconded the motion and upon voice vote, was approved without dissent.

The meeting ended at 8:26 p.m.
