Village of Northbrook Board of Trustees met Oct. 30.

Please Note - Members of the public wishing to respectfully share thoughts about any matter concerning the Northbrook Board of Trustees may do so by coming to a meeting and speaking during the "Public Comment" time on general matters, or by speaking if and when comment is called during debate on a specific matter that is listed on the agenda. Members of the public can also submit a written comment via the Village's website. Each written comment submitted on the website will be delivered to each member of the Village Board prior to the meeting but will not be read out loud at the meeting unless specifically requested. Please note that while the Village Board will not immediately respond to public comments at the meeting, or engage in a back and forth discussion during the meeting, we are of course actively listening to all comments, thoughts, and suggestions. A. Approval Documents Related to the Termination of the 2019 Northbrook Court Redevelopment & Economic Incentive Agreement and 2019 Northbrook Court TIF District

As envisioned in the Pre-Development Agreement between the Village of Northbrook and Brookfield Properties approved on May 23, 2023, this is an initial step in the final approval process for all actions related to the redevelopment of Northbrook Court. The following documents are attached for consideration: 

i. A Resolution Approving a Mutual Termination and Release of Redevelopment & Economic Incentive Agreement by, between, and among the Village of Northbrook, Northbrook Anchor Acquisition, LLC, Northbrook Court Residential Owner LLC, and Northbrook Court NewCo LLC 

ii. An Ordinance Terminating the Designation of the Northbrook Court Tax Increment Financing Redevelopment Project Area and Dissolving the Northbrook Court Special Tax Increment Allocation Fund 

B. Land Use Approval Documents Related to The Northbrook Court Planned Development

As discussed by the Village Board as part of the Public Hearing on August 29, 2023, the following resolution and ordinances have been prepared by the Village Attorney to approve various land use actions related to the redevelopment of Northbrook Court including: 

i. A Resolution Approving a Combined Tentative and Final Plat of Subdivision - The Northbrook Court Planned Development 

ii. An Ordinance Amending Articles V and XI of the Northbrook Zoning Code Relating to Regulations and Uses Within the C-4 Regional Shopping District 

iii. An Ordinance Granting Special Permits for a Mixed Use Planned Development (including Combined Development Concept Plan and Final Plan Approval), and for Certain Specified Uses in the C-4 Regional Shopping District - The Northbrook Court Planned Development 

C. Approval Documents Related to Establishment of the Northbrook Court II Tax Increment Financing and Northbrook Court Business District and Approval of the Northbrook Court Redevelopment and Economic Incentive Agreement As discussed by the Village Board at Public Hearings on August 22, 2023, the following ordinances and resolution have been prepared by the Village Attorney to establish both the new Northbrook Court II TIF District and the new Northbrook Court Business District and associated 1% business district sales tax at Northbrook Court via the following actions: 

i. An Ordinance Approving a Tax Increment Financing Redevelopment Plan and Project for the Northbrook Court II Redevelopment Project Area 

ii. An Ordinance Designating the Northbrook Court II Redevelopment Project Area Pursuant to the Tax Increment Allocation Redevelopment Act 

iii. An Ordinance Adopting Tax Increment Allocation Financing for the Northbrook Court II Redevelopment Project Area 

iv. A Resolution Expressing Official Intent regarding Certain Capital Expenditures within the Northbrook Court II Redevelopment Project Area to be Reimbursed from Proceeds of One or More Obligations to be Issued by the Village of Northbrook 

v. An Ordinance Approving a Business District Plan for the Northbrook Court Business District and Designating the Northbrook Court Business District 

vi. An Ordinance Imposing a Business District Retailers’ Occupation Tax and a Business District Service Occupation Tax Within the Northbrook Court Business District 

vii. An Ordinance Approving a Redevelopment & Economic Incentive Agreement by, between, and among the Village of Northbrook, Northbrook Court NewCo LLC, and Northbrook Anchor Acquisition, LLC, and Providing for the Issuance of Notes, Terms of Notes, and Execution of Note Orders in Connection Therewith 

6. CONSENT AGENDA 

The matters listed for consideration on the Consent Agenda are matters that appear to have the unanimous support of the Board of Trustees. The Village President will review, designate the resolution or ordinance number for passage and then inquire if any member of the Board or member of the public objects to any item on the Consent Agenda. If any objections are raised, the matter will be removed from the Consent Agenda and relocated to a location on this agenda for consideration during the appropriate Board Committee report. If no objection is voiced, the Village President will request a motion and second for passage of all items listed. The resultant roll call vote on the Consent Agenda will be applicable to each individual agenda item.
