City of Elgin Planning & Zoning Commission met April 3.

The regular meeting of the Planning & Zoning Commission was called to order at 7:00 p.m. in the City Council Chambers by Chairman Cox in the City Council Chambers, 2nd Floor North Tower, 150 Dexter Court, Elgin, IL, 60120.
Members Present: Nancy Abuali, Steven Migala, Berto Valdez, Jordan Wildermuth, and Chairman Cox.
Members Absent: Alejandro Lopez, Karin Jones.
Staff Present: Damir Latinovic, Senior Planner;
APPROVAL OF MINUTES:
Motion made by Commissioner Wildermuth to approve the minutes of March 6, 2023, as submitted.
The motion was seconded by Commissioner Valdez.
The motion passed 5-0.
Oath Administered: The court reporter administered the oath to all persons desiring to testify.
PETITION TO BE CONSIDERED:
Consideration of Petitions 07-23 - 20 S. State Street
Requesting a conditional use to establish a tobacco store at the property commonly referred to as 20 S. State Street, by Galaxy Elgin, LLC, as applicant, and Parkway Bank and Trust Co. Trust No. 10907/Rick Heidner, as property owner.
Two persons spoke regarding the petition.
Commissioner Abuali moved to recommend that City Council approve Petitions 07-23, subject to the conditions outlined within the staff report, and to adopt as the findings of the Commission, the documents and conditions provided within such staff report.
Commissioner Migala seconded the motion, which was adopted 5-0.
Consideration of Petitions 08-23-500 S. McLean Boulevard
Requesting a conditional use to permit accessory package liquor sales at the existing motor vehicle service station and convenience food store at the property commonly referred to as 500 S. McLean Boulevard, by Chirag Patel, as applicant, and LGP Realty Holdings LP, as property owner.
One person spoke regarding the petition.
Commissioner Wildermuth moved to recommend that City Council approve Petitions 08-23, subject to the conditions outlined within the staff report, and to adopt as the findings of the Commission, the documents and conditions provided within such staff report.
Commissioner Abuali seconded the motion, which was adopted 4-1. (Cox)
Consideration of Petitions 04-23 - 268 S. State Street
Requesting approval of a planned development as a conditional use with departures from the Elgin Municipal Code requirements for the location of a refuse collection area, the height of a wall within a street yard, and any other departures as may be necessary or desirable, to establish a packaged liquor sales establishment at the property commonly referred to as 268 S. State Street, by Andy Patel, Mr. A's Walnut Wine & Liquor, as applicant, and Heidner Properties Inc., as property owner.
Several persons spoke regarding the petition.
Commissioner Migala moved to recommend that City Council deny Petition 04-23, based on not meeting the suitability standard (site characteristics standard).
Commissioner Valdez seconded the motion, which was adopted 5-0.

PENDING DEVELOPMENT APPLICATIONS:
Mr. Latinovic gave a summary of pending applications.
ADJOURNMENT: Motion to adjourn was made by Commissioner Abuali. The motion was seconded by Commissioner Migala.. The motion passed unanimously.
