1. Consider a Motion Approving the Final Fence and Screening Plan Along Hicks Road for the Ayreshire Subdivision (Northwest Corner of Hicks Road & Garden Avenue) - Approved by Voice Vote (Council District: Three)

Planning & Zoning Director Ben Vyverberg explained that last October the Council requested a landscaping and sidewalk plan along the west side of Hicks, replacement of parkway trees in Hicks Road ROW, and detailed landscaping and elevation plans. These requests were incorporated into the plan revisions along with more aesthetic fencing and landscaping plans and regrading to Walgreens. Staff recommends approval of the Final Fencing and Screening Plan for the Hicks Road units at Ayreshire Subdivision.

Councilman Myslinski thanked the petitioner for listening to the concerns of the Council and working with staff to incorporate changes.

B. POLICE POLICY & CODE SERVICES COMMITTEE – Time: 7:06 PM

1. Consider an Ordinance Granting a Special Use for a Front Yard Setback at 326 N. Clark Drive - Motion Carried by Voice Vote (Council District: Four)

Planning & Zoning Director Ben Vyverberg presented the petitioner's request for a Special Use to permit a front yard setback to be 18 feet from the side yard lot line (instead of the required 30 feet) to expand the single story, 1- car garage to an oversized 2-car garage. Vyverberg noted the change in the text amendment addressing front and side yards based on orientation of the home.

The ZBA voted unanimously to approve the Special Use and staff concurs.

2. Consider an Ordinance Granting a Special Use and Variation for a Deck at 870 N. Virginia Lake Drive - Motion Carried by Voice Vote (Council District: Five)

Planning & Zoning Director Ben Vyverberg presented the petitioner's request for a Special Use to permit a raised (9.5 feet) deck in the floodplain and a Variation to permit a portion of the raised deck to be located 20 feet from the rear lot line, instead of the minimum required 25 feet. The lot coverage is non-conforming at 48.2% instead of the 45% permitted. The ZBA voted unanimously to approve the Special Use and staff concurs.

Planning & Zoning Director Ben Vyverberg presented the petitioner's request for a Special Use to permit a medical (chiropractor) office in a planned development shopping center. The ZBA voted unanimously to approve the Special Use and staff concurs.
