City of Elgin Planning & Zoning Commission met July 10.

Here are the minutes provided by the commission:

The regular meeting of the Planning & Zoning Commission was called to order at 7:00 p.m. in the City Council Chambers by Chairman Cox in the City Council Chambers, 2nd Floor North Tower, 150 Dexter Court, Elgin, IL, 60120.

Members Present: Nancy Abuali, Karin Jones, Steven Migala, and Chairman Cox.

Members Absent: Alex Lopez, Berto Valdez, and Jordan Wildermuth

Staff Present: Damir Latinovic, Senior Planner.

APPROVAL OF MINUTES: 

Motion made by Commissioner Jones to approve the minutes of June 5, 2023, as submitted. 

The motion was seconded by Commissioner Abuali.

The motion passed 3-0-1 (Migala abstained).

Oath Administered: The court reporter administered the oath to all persons desiring to testify.

PETITION TO BE CONSIDERED: 

Consideration of Petition 09-23 

Requesting a conditional use to establish a physical fitness facility and an other school and educational facility, more specifically an afterschool tutoring center, at the property commonly referred to as 345 S. McLean Boulevard, by Jose Garibay, as applicant, and Olson Family Joint Declaration of Trust, as property owner.

There was no public comment.

Commissioner Abuali moved to recommend that City Council approve Petition 09-23, subject to the conditions outlined within the staff report, and to adopt as the findings of the Commission, the documents and conditions provided within such staff report. Commissioner Jones seconded the motion, which was adopted 4-0.

Due to the conflict-of-interest Chairman Cox announced he will recuse himself from the public hearing for the next petition, and invited the Commission to appoint a Chairperson Pro Tem.

Commissioner Abuali moved to appoint Commissioner Migala as the Chairman Pro Tem. Commissioner Jones seconded the motion, which was adopted 4-0.

Consideration of Petition 12-23 

Requesting approval of a planned development as a conditional use with departures from the Elgin Municipal Code requirements for the height of a fence within the street yard, and any other departures as may be necessary or desirable, to construct a six-foot high, open-design fence in the street yards south and east of the existing building at the property commonly referred to as 450 Shepard Drive, by Grand Legacy Group LLC, as applicant, and Elgin Properties LLC, as property owner.

There was no public comment.

Commissioner Jones moved to recommend that City Council approve Petition 12-23, subject to the conditions outlined within the staff report, and to adopt as the findings of the Commission, the documents and conditions provided within such staff report.

Commissioner Abuali seconded the motion, which was adopted 3-0-1 (Cox abstained).

Chairman Cox resumed the chairperson duties.

Consideration of Petition 05-22 

Requesting approval of an amendment to conditional use Ordinance No. G6-07 and a planned development as a conditional use with departures from the Elgin Municipal Code requirements for the number of principal buildings on a zoning lot, maximum permitted building floor area, minimum required vehicle use area interior yard setback, minimum required vehicle use area street yard setback, minimum number of parking spaces, minimum vehicle use area interior landscape yard, the location of a refuse collection area, and any other departures as may be necessary or desirable, to construct a three-story, mixed-use building with approximately 1,550 square feet of commercial space and 16 residential units with 32 garage parking spaces at the property commonly referred to as 16-24 Airlite Street, by Airlite Square LLC, as applicant and property owner.

There was no public comment.

Commissioner Migala moved to recommend that City Council approve Petition 05-22, subject to the conditions outlined within the staff report, and to adopt as the findings of the Commission, the documents and conditions provided within such staff report. Commissioner Jones seconded the motion, which was adopted 4-0.

Consideration of Petition 16-23 

Requesting approval to amend Title 19 "Zoning" of the Elgin Municipal Code to amend the list of uses which are prohibited within the ARC Arterial Road Corridor Overlay District as well as the circumstances under which those uses are prohibited in the ARC Arterial Road Corridor Overlay District., by the Development Administrator of the City of Elgin, as applicant.

At staff's request, Commissioner Abuali moved to recommend that the Planning and Zoning Commission continue this petition to the next regularly scheduled Planning and Zoning Commission meeting on August 7, 2023 at 7 pm.

Commissioner Jones seconded the motion, which was adopted 4-0.

PENDING DEVELOPMENT APPLICATIONS: 

Mr. Latinovic gave a summary of pending applications.

ADJOURNMENT: 

Motion to adjourn was made by Commissioner Jones The motion was seconded by Commissioner Valdez.

The motion passed unanimously.

The meeting of the Planning & Zoning Commission was adjourned at 8:10 p.m.
