City of Elgin Committee of the Whole met Aug. 24.

Here are the minutes provided by the committee:

The regular Committee of the Whole meeting was called to order by Mayor Kaptain at 6:00 p.m. in the Council Chambers. Present: Councilmembers Dixon, Good, Martinez, Powell (6:03 p.m.), Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Absent: None.

Approval of Minutes

Councilmember Shaw made a motion, seconded by Councilmember Thoren, to approve the minutes of the August 10, 2022 regular meeting. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.

Fourth Amendment to Intergovernmental Agreement with the Village of South Elgin for Interceptor Sewer Access

A resolution was presented at the Council meeting for adoption by the City Council for the fourth amendment to the intergovernmental agreement with the Village of South Elgin for interceptor sewer access to promote the orderly development of land.

There was discussion regarding the maintenance of the sewer and how the cost of future repairs to the interceptor sewer line would be shared between the two communities.

FEMA Assistance to Firefighters Grant (AFG) Acceptance

Councilmember Martinez made a motion, seconded by Councilmember Powell, to authorize the acceptance of the FEMA Assistance to Firefighters Grant in the amount of $189,188 and approve payment of the required City share of $18,919 in order to send six (6) firefighters to paramedic class over 2023 and 2024. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.

Construction Engineering Services Agreement with Burns & McDonnell Engineering Company Inc for the Alft Lane and Randall Road Intersection Improvements Project

Councilmember Powell made a motion, seconded by Councilmember Thoren, to enter into an agreement with Burns & McDonnell Engineering Company, Inc. in an amount of $168,179 to provide field inspection, design interpretation, contract administration, documentation, and general coordination and control of the day-to-day construction activities for the addition of left turn lanes on Alft Lane and an additional driving lane on Randall Road from Alt Lane to I-90. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.

Design Engineering Services Agreement with Engineering Enterprises, Inc for the 2023 Country Knolls Resurfacing Project

Councilmember Martinez made a motion, seconded by Councilmember Shaw, to enter into an agreement with Engineering Enterprises, Inc. for an amount not to exceed $129,916 to analyze, design, and prepare construction documents for the resurfacing of various residential streets for the 2023 Neighborhood Street Resurfacing Program. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.

Design Engineering Services Agreement with Gewalt Hamilton Associates, Inc for the 2023 Providence Resurfacing Project

Councilmember Martinez made a motion, seconded by Councilmember Shaw, to enter into an agreement with Gewalt Hamilton Associates, Inc. for an amount not to exceed $170,500 to analyze, design, and prepare construction documents for the resurfacing of various residential streets for the 2023 Neighborhood Street Resurfacing Program. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.

Design Engineering Services Agreement with Hampton, Lenzini & Renwick, Inc. for the 2023 Eastside Resurfacing Project

Councilmember Martinez made a motion, seconded by Councilmember Good, to enter into an agreement with Engineering Enterprises, Inc. for an amount not to exceed $116,690 to analyze, design, and prepare construction documents for the resurfacing of various collector and residential streets for the 2023 Collector Street Resurfacing Program. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.

Change Order 1 and Final Spring Street Parking Structure Concrete and Maintenance Repairs – Bid 21-003

There was discussion regarding construction noise associated with the project and the City’s noise ordinance.

Councilmember Steffen made a motion, seconded by Councilmember Good, to increase the Spring Street Parking Structure Concrete and Maintenance Repairs contract awarded to J. Gill and Company by the amount of $15,000 in order to repair failed post-tension connections discovered during initial repairs. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.

Nightmare on Chicago Street Power Distribution Rental

There was discussion regarding the budget for the event and concern expressed over fewer companies bidding on items needed.

Councilmember Steffen made a motion, seconded by Councilmember Good, to approve a contract with Sunbelt Rentals in the amount of $29,191 to secure power distribution equipment rental for Nightmare on Chicago Street. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Powell, Rauschenberger, Steffen, Thoren, and Mayor Kaptain. Nays: Councilmember Martinez. Councilmember Shaw abstained.

Discussion on Ordinance Regarding Internal Investigations by Independent Outside Person or Entity Retained by the City (Sections 2.44.030 and 2.52.165) (Councilpersons Shaw and Thoren)

There was discussion on the city council’s understanding and expectations relating to the independence and integrity of the internal investigations conducted by an independent outside entity retained by the city under Section 2.44.03 and 2.52.165 of the Elgin Municipal Code.

Background information on why the independent outside entity was retained by the city was provided. Points of discussion included: the municipal code sections listed above; the process on how to address questions to the independent outside entity; how the final report of findings is provided to the Council and staff; as well as which entity should issue the letter of determination to the resident that initiates the investigation.

Councilmember Powell made a motion, seconded by Councilmember Dixon, to remind the outside person or entity retained by the city who conducts such internal investigations to simultaneously issue written findings in a report to the chief of police, the mayor and members of the city council. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Powell, Rauschenberger, and Steffen. Nays: Councilmembers Martinez, Shaw, Thoren, and Mayor Kaptain. Motion passed.

Councilmember Powell made a motion, seconded by Councilmember Dixon, to have the outside independent entity that conducted the independent investigation issue the final letter of determination regarding the complaint to the resident. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Powell, Rauschenberger, Steffen, and Mayor Kaptain. Nays: Councilmembers Martinez, Shaw, and Thoren. Motion passed.

Councilmember Shaw made a motion, seconded by Councilmember Martinez, to have council process all questions relating to internal investigations to the appropriate city staff to communicate to the outside person or entity retained by the city. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: Councilmember Powell. Motion passed.

Announcements from Council

Mayor Kaptain and members of the council issued their condolences to the family of Karen Beyer who was the former CEO of the Ecker Center for Mental Health and pillar of the Elgin community.

Councilmember Thoren reminded residents that the upcoming Historic Elgin House Tour is back and encouraged the community to attend.

Councilmember Dixon announced the passing of Associate Minister Rev. Dr. Randall Hodges of the Second Baptist Church of Elgin and expressed condolences to his family.

Councilmember Powell also expressed her condolences to the Hodges and Beyer families. She congratulated Councilmember Dixon on organizing and assisting in another successful Back to School event that benefitted the community.

Announcements from Staff

Rick Kozal, City Manager, announced upcoming city events as well as communicated a compliment to 311 staff issued by a resident.

Councilmember Martinez made a motion, seconded by Councilmember Shaw, to adjourn the meeting. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.
