1. Consider a Motion Approving the Halloween Hustle 5K & Kids Dash, Including a Waiver of the Village's Sound Amplification Ordinance and Temporary Closure of a Portion of Eric Drive, on Saturday, October 29, 2022 - Approved by Voice Vote (Council District: Six)

Village Manager Reid Ottesen presented Adrenaline Sports Management's request for a waiver of the Sound Amplification Ordinance for announcements and music. Staff recommends a waiver from 8:00 AM to 10:30 AM for the Halloween Hustle, 5K in downtown Palatine on Saturday, October 29.

Aaron Del Mar, 1165 N. Lakeside Drive, organizer, stated proceeds will benefit Father’s Helping Fathers, and the potential 800 participants will have a positive impact on local businesses.

2. Consider a Resolution Approving a Collective Bargaining Agreement Between the Village of Palatine, Illinois and the International Union of Operating Engineers Local No. 150, Public Employees Division - Adopted by Voice Vote

Village Manager Reid Ottesen recommended a resolution approving the proposed 3-year Collective Bargaining Agreement between the Village and the International Union of Operating Engineers Local 150, replacing the previous agreement which expired December 31, 2021. The agreed-upon wage increases are: 2.25% in 2022 retroactive to January 1, 2022; 2.5% in 2023; and 2.75% in 2024. The proposed contract offers a change in work schedule beginning next August from 7:00 AM to 3:30 PM to take advantage of daylight hours in winter and to respond to work requests later in the day.

1. Consider a Motion Granting Approval of a Waiver of the Village's Sound Amplification Ordinance for Patio Music at Chicago Culinary Kitchen, 2391 N. Hicks Road, on Saturday, September 24, 2022 - Approved by Voice Vote (Council District: Three)

Village Manager Reid Ottesen recommended Chicago Culinary Kitchen's request for a waiver of the Sound Amplification Ordinance, for live music on their patio on Saturday, September 24 from 3PM to 7PM.

2. Consider an Ordinance Granting a Special Use for a Fence in a Front Yard at 433 N. Stark Drive - Motion Failed by Roll Call (Council District: Four)

Planning & Zoning Director Ben Vyverberg presented the petitioner's resubmitted request to install a proposed fence:

∙ 4-foot front yard fence has 1’ x 3’ pickets, spaced 2.5” apart, which allows for 50% of the fence sections (6’ x 4’) to be see-thru and open;

∙ Including the Wilson Court parkway, the proposed fence is approximately 72 feet north of the intersection of Wilton Court and Stark Drive; and

∙ Staff reviewed the Village’s Codes and Ordinances for line of sight requirements

Petitioner presented views of the street site lines, per Village request.

Councilman Helms summarized the change to have more open fencing by 50% with maximum height of 4 feet in front that does not violate site lines.

Mayor Schwantz, Councilmen Millar and Myzlinski, stated they cannot support the solid appearance from an angle, blocking view.

Vyverberg restated the petitioner wants the fence on the property line, not relocating and angling the corners as suggested by Councilman Solberg.

Councilman Kozlowski favors the fence.

Jeremy Hall, 433 N Stark, does not favor going back 15 feet, he presented multiple examples of solid fences in front yards: Carpenter and Glenn & Anderson and Norman. He feels his offer to reduce to 4 feet should be accepted.

Angela Hall, 433 N. Stark, noted that putting in a live hedge would accomplish their goal with no approval.

In response to Councilman Helms, Hall rejected wrought iron. To angle the fence would forfeit half of their yard. Code allows 5 foot setback. Petitioners asked to call the question.

Village Manager Reid Ottesen noted this item comes before the Council in Standing Committee.

The Petitioners maintain their request to allow the 4-foot picket fence to be set back 5 feet from the front property line.

3. Consider an Ordinance Imposing a Moratorium on the Issuance of Additional Video Gaming Licenses as Defined in Section 3-35 of the Palatine Code of Ordinances - Motion Carried by Voice Vote

Village Manager Reid Ottesen presented staff's response to the Council's request for a moratorium on Video Gaming. Due to the need to evaluate existing code provisions and impacts of gaming licenses Village-wide, staff will continue to process the remaining five applications on file with the Village Manager’s office but supports the moratorium through March 31, 2023, on any additional applications, pending review, to determine the necessity of further modifications to our Code of Ordinances. Council may end or extend the moratorium. Staff will prepare a report for the Village Council in the first quarter of 2023. Staff recommends approval.

Councilman Helms noted the timing with Liquor License issuance.

Mayor Schwantz expressed respect for the enormous requirement of staff time and the careful, calculated method of approval.

Consider an Ordinance Approving Various Text Amendments to Exhibit A (Zoning Ordinance) of the Village of Palatine Code of Ordinances Regarding Article 13 (13.07), Article 14 (14.03, 14.05, and 14.11) and Exhibit B (Subdivision Ordinance) of the Code of Ordinances, Articles 3 and 4 (3.01 and 4.01) - Motion Carried by Voice Vote

Community Development Director Mike Jacobs presented the staff's recommended changes after review of the zoning petitions over the last 5 years. To eliminate confusion or ambiguity, Administrative Special Use/Variations would be processed solely at a staff level (provided the petitioner gets sign offs from the surrounding property owners). Otherwise, the standard Special Use/Variation process would be required. Notice to occupants is replaced with notice to tax payer of record in compliance with the State of Illinois.

However, the Plan Commission recommended that notice to occupants be reduced to those within 125 feet (250 feet is the current requirement) of the Subject Property. If not supported by staff or neighbors, the standard Special Use/Variation process would be required. The Plan Commission voted unanimously to approve the requested text amendments, including a requirement to send notification to all occupants within 125 feet of a subject property.

Staff concurs with the other proposed text amendment recommendations but maintains its recommendation to eliminate the notification to occupants.

Councilman Millar is cautious of 10% setback reduction or less, and recommended 6 month follow up.

Village Manager Reid Ottesen clarified neighbor notification saving weeks in the streamlined process.

Any Variation or Special Use request requires written notice. In an Administrative Variation, the petitioner can get approval of neighbors. Legally, notifying the owner or taxpayer of record is required.

Councilman Solberg favors the Village asking for neighbor approval, noting the possibility of personality conflict among neighbors. Jacobs stated the petitioner can select Administrative Approval or the traditional process.

1. Consider a Motion Authorizing the Village Manager to Pre-Purchase a Replacement Five-Ton Dump Truck - Approved by Voice Vote

Public Works Director Matt Barry recommended waiving formal bid procedures and authorizing the Village Manager to pre-purchase one Freightliner 108SD single-axle chassis five-ton dump truck from Northwest Trucks and associated outfitting costs for a total cost not to exceed $217,330.

2. Consider a Motion to Affirm the Purchase of 2022 Budgeted Vehicles and Pre-Purchased 2023 Light Duty Vehicles - Approved by Voice Vote

Public Works Director Matt Barry recommended affirming the vehicles purchased as planned for replacement in 2022 and pre-purchased from the 2023 replacement schedule in the total amount of $665,885. Of the $1,321,000 authorized at the June 20 Council meeting, there is a balance of $665,115 for completing the remaining purchases.

Village Manager Reid Ottesen complimented Public Works for finding the best cost and saving taxpayers.

3. Consider a Motion Authorizing the Village Manager to Purchase a Replacement Stump Grinder - Approved by Voice Vote

Public Works Director Matt Barry recommended authorizing the Village Manager to purchase one 2022 Vermeer SC802 tow-behind stump grinder with safety items through the Sourcewell contract from Vermeer Midwest in the amount of $66,301.74. Barry also recommended approval of trading in the existing Rayco stump grinder to Vermeer Midwest for a credit of $18,000, for a net purchase price of $48,301.74.

Village Manager Reid Ottesen cited the Council's recommendation to discontinue the Village vehicle sticker program and recommended approval of the Text Amendments to Chapter 18, Article 2 of the Village Code to delete reference to Vehicle Licenses. Ottesen noted that no new tax is being added. This is absolute savings for the taxpayer. Pet registration continues with no tags and no cost, just registration.

Councilmen Kozlowski and Millar recommended publicizing this action--a direct savings to the residents.

1. Consider an Ordinance Granting a Special Use for a Fence in a Front Yard at 433 N. Stark Drive - Motion Carried by Roll Call (Council District: Four)

This item was denied at Committee Level.

Jeremy Hall, 433 N. Stark, petitioner, proposed a compromise to go to 10 feet off the property line and cut the corners at 45 degrees at 15 feet.

Mayor Schwantz noted the character of the neighborhood. There will be some landscaping as well.

Mayor Schwantz thanked Mr. Hall for the compromise. Landscaping is not required, petitioner is offering 4 foot landscaping.

Discussion ensued with Councilmen expressing various concerns and options.

Substitute motion: to approve the 4 foot high wood fence with a 15 foot setback.
