A. Continued Review of the Municipal Code

Clerk Ford began by stating that final review and approval of the Municipal Code is presently scheduled to take place at either the first or second regular board meeting in April.

ξ Chapter 13 - Food will be combined into Chapter 15. Chapter 13 will be eliminated/reserved.

ξ Chapter 14 - Human Rights will have parts folded into Chapter 2 and the rest will be eliminated/reserved.

ξ Chapter 15 - Licensed Permits and Business Regulations will be brought back with Chapter 13, which will be looked at after the COVID pandemic has improved. At that time, the regulations implemented during COVID will be reviewed. Some may be incorporated into code.

President Frum stated that Chapter 15 - Licenses, Permits and Business Regulations, includes businesses that currently are required to get permits and licenses. Those businesses have already received license for this year. There is now leeway for making changes and putting new regulations in place for next year. Current business licenses expire December 31st. This chapter will come back to the Board later in this year.

Attorney Lenneman reviewed the proposed substantive changes to Chapters 19 and 27. Chapter 19: Planning and Development

A change to Article 4 eliminates continued collection of transportation impact fees. The provisions that govern collection of the funds have been eliminated.

Section 19-132 titled Permit Classes relates to permits issued for applicants wanting to increase their impervious surface area. There are three permit classes in the existing Code. The Storm Water Commission reviewed and recommended a 4th class for properties located in a planned development. Homeowners that desire to increase the impervious surface area within a planned development would have to demonstrate that the planned development has existing access to storm water retention available or propose an increase of the detention/retention to compensate for the increase in impervious surface area.

President Frum referred to a letter received from an individual wanting to add to her impervious surface. Village Engineer Matt Farmer and Adele Sturgis from the Stormwater Management Commission provided responses detailing why the request should not be granted. The responses were included in the packet. Trustee Israel stated that Ms. Sturgis provided a clear explanation summing up reasons for her recommendation and also provided good reasoning for adding a Class 4. Trustee Israel stated there is a good reason not to allow expansion of impervious area in already developed Planned Urban Developments (PUD).

Trustee Israel had a question with language in terms of remediating grading changes in Section 19-126. He stated that after speaking with Ms. Lenneman the issue had been resolved.

President Frum asked if there were any questions. There were no questions.

Chapter 27: Water Sewer and Sewer Disposal

Section 27-34 is titled Water Conservation Practices. Amendments were made to the section to acknowledge that the Village now requires water sense labels on all new fixtures installed in the Village. A reference was added to Chapter 6 that states a water sense label is still required.

Prior review stated that Subsection E was to have been deleted but after further review it has been reinserted after finding out it was not included in the Illinois Plumbing Code.

Section 27-123 titled Streetwork was deleted because it is a duplicate of standards already set forth in Chapter 22.

Section 27-48 titled Repairs and Maintenance was amended to clarify the Village’s authority to repair certain plumbing fixtures if the owner of the property fails to do so.

Section 27-150 is titled Prohibition or Pretreatment of Certain Discharges. This section included substances prohibited by the Metropolitan Water Reclamation District’s (MWRD) ordinance. Those were removed and reference was included to the MWRD ordinance itself as the ordinance is subject to change. It has been clarified that the information is contained in Article 3 of the ordinance.

Clerk Ford stated the Trustees will be reviewing the final Chapters 1 and 2 at the March 9th, regular board meeting.

Trustee Pepoon moved, seconed by Trusstee Israel to go into Executive Session to discuss personnel. On voice vote, all were in favor.
