President Hayes and the following Trustees responded to roll: LaBedz, Rosenberg, Scaletta, Baldino, Canty, Padovani, Tinaglia, Schwingbeck.

Also present were: Randy Recklaus, Cris Papierniak, Thomas Kuehne, Robin Ward, Charles Perkins, Diana Mikula and Becky Hume.

IV. APPROVAL OF MINUTES

A. Village Board 11/4/2019 Approved

Trustee Robin LaBedz moved to approve. Trustee Greg Padovani Seconded the Motion.

V. APPROVAL OF ACCOUNTS PAYABLE

A. Warrant Register 11/15/2019 Approved

Trustee Bert Rosenberg moved to approve the Warrant Register in the amount of $2,326,667.89. Trustee John Scaletta Seconded the Motion.

VI. RECOGNITIONS AND PRESENTATIONS

A. Presentation of Proclamation to James P. Ostler, Sr.

President Hayes honored Mr. James Ostler, a veteran and member of the Greatest Generation. Mr. Ostler will receive the French Legion of Honor on Thursday, November 21, 2019. The award recognizes eminent service to the French Republic. In World War II, Mr. Ostler flew in 25 combat missions in the B-17 Bomber. President Hayes presented Mr. Ostler with a proclamation from the Village of Arlington Heights.

VII. PUBLIC HEARINGS VIII. CITIZENS TO BE HEARD

William Boodro said at the Village Board meeting of November 4th, many people spoke over their 3 minutes. He said the comments took longer than they should have and he told President Hayes to keep to the deadline. Mr. Boodro said he understood President Hayes did not want to be rude. President Hayes said he was very mindful of the clock. Mr. Boodro asked if the new State Legislation eliminates the sale of medical marijuana as someone he knows suggested. He asked if the medical dispensary in the Village will close. He said he couldn’t find the information in the 610 pages of the new law.

Ms. Ward said medical marijuana is still allowed in Illinois and it was not eliminated. There are some tweaks to the regulations, but it is still allowed.

President Hayes said the Village Board does not regulate the dispensary.

IX. OLD BUSINESS

A. Report of the Committee of the Whole meeting of November 12, 2019

Arlington Heights Memorial Library Budget Review

Trustee Canty moved, seconded by Trustee LaBedz, that the Committee-of-the-Whole recommend to the Board of Trustees that the Board acknowledge with thanks the proposed budget for the Arlington Heights Memorial Library Fund. The motion passed unanimously.

Trustee Mary Beth Canty moved to approve. Trustee Robin LaBedz Seconded the Motion.

B. Report of the Committee-of-the-Whole meeting of November 14, 2019 Approved

Meet Chicago Northwest (3 year agreement)

Trustee Padovani moved, seconded by Trustee Canty that the Committee-of-the-Whole recommend to the Village Board of Trustees that the Board approve a three-year budget agreement for the Meet Chicago Northwest Convention Bureau with each year being funded at 8% of the hotel tax receipts. The motion passed unanimously.

Trustee Greg Padovani moved to approve. Trustee Mary Beth Canty Seconded the Motion.

C. Report of the Committee-of-the-Whole meeting of November 14, 2019

Final Recommendation of the Committee-of-the- Whole to the Board of Trustees for the 2019 Property Tax Levy payable in 2020

Trustee Tinaglia moved, seconded by Trustee Schwingbeck that the Committee-of-the-Whole recommend to the Village Board of Trustees to authorize staff to prepare the Village's and Arlington Heights Memorial Library's 2019 Tax Levy Ordinance reflecting an estimated total tax levy of $51,315,596 or a 0% increase over the 2018 extended tax levy for the Village and Library portion of the levy. The motion passed unanimously.

Mr. Boodro questioned the amounts the Village was keeping in reserve and the decision to increase water rates in addition to issuing a bond for water. He stated that retirements over the next few years will be a large bill to pay, he questioned the borrowing of money.

Mr. Kuehne invited Mr. Boodro to call him to discuss the issue directly. The Water and Sewer fund is only funded through water and sewer revenues. The $30 million reserve is for operating funds and cannot be used for water and sewer funding.

Mr. Recklaus said one of the reasons the Village gets good rates is because it retains a certain percentage of funds in reserve. The Village doesn’t have backstop options and can’t stop operating in the event of funds being withheld or revenues unpredictably declining. The amount of reserves the Village keeps isn’t the highest, but it is within the generally accepted accounting principles for a public operation.

Trustee Jim Tinaglia moved to approve. Trustee Tom Schwingbeck Seconded the Motion.

D. Report of the Committee-of-the-Whole meeting of November 14, 2019 Approved

Final Recommendation of the Committee-of-the- Whole to the Board of Trustees for the 2020 Budget

Trustee LaBedz moved, seconded by Trustee Rosenberg that the Committee-of-the-Whole recommend to the Village Board of Trustees that the Board approve the Proposed 2020 Budget as amended through the review process. The motion passed unanimously.

Trustee John Scaletta moved to deny the issuance of a Class A Liquor License to J&D Mowa Inc. dba Mowa, located at 4216 N. Arlington Heights Road. Trustee Robin LaBedz Seconded the Motion.

CONSENT REPORT OF THE VILLAGE MANAGER

A. Bond Waiver -Arlington Heights Park District Approved

Resident Melissa Cayer asked for this item to be taken off the Consent Agenda.

Melissa Cayer asked what a bond was. Ms. Ward explained if an organization has a raffle, they must have a bond to ensure the raffle operator doesn’t run off with someone’s money. Because this request is from a government entity, the Village is not requiring them to have a bond. Trustee Scaletta said this request comes forward quite often from organizations in town like churches, scout groups, and the Legion Hall. This request is not out of the ordinary.

XI. APPROVAL OF BIDS

XII. NEW BUSINESS

A. The LaSalle Estates Subdivision - 2000 N. Chestnut Ave. - PC#19-009 Preliminary and Final Plat of Subdivision, Variation Approved

Sean Kelly said they want to subdivide the property into 3 single family home sites.

Mr. Perkins said the property was annexed in the early 1970’s. It requires a setback variation on lot 3. Staff is recommending 30’ versus 40’ so the lot is consistent with the properties to the east. They are providing storm water drainage through private detention that would then flow into the Village’s drainage system.

Trustee Rosenberg asked if there will be sufficient for water detention. Mr. Perkins said according to Chief Engineer Pagones, it will be sufficient. Staff contacted a concerned resident and it was determined that their previous water event occurred during the flood of 2011. That owner’s problem could have been because of multiple issues. This area does not a pattern of historical flooding. Staff is comfortable with the payment in lieu of additional detention. As it is a small subdivision, it doesn’t require a detention basin. Ladd Street will be maintained during construction for access to two homes.

Mr. Kelly said he changed the orientation of one of the lots so there will not be 3 driveways off LaSalle. One home will have a side load driveway.

Mr. Kelly agreed to the 7 conditions.

XIII. LEGAL

A. An Ordinance Approving an Agreement between the Village of Arlington Heights and the Arlington Heights Firefighters Association, Local 3105, I.A.F.F. (2020-2022) Approved

Mr. Recklaus said staff has negotiated a 3 year agreement with the Arlington Heights Firefighters Association, Local 3105, I.A.F.F. There are very few changes from the current contract. The new contract has some wage increases and insurance adjustments.

Chief Larsen said the process was positive.

Trustee Robin LaBedz moved to approve Ordinance 19-048, an agreement between the Village of Arlington Heights and the Arlington Heights Firefighters Association, Local 3105, I.A.F.F. Trustee Mary Beth Canty Seconded the Motion.

The Motion: Passed

President Hayes invited residents to the Holiday Tree Lighting Friday, November 29th at 4:15 p.m. at North School Park.

Trustee Padovani said this Thanksgiving marks the 23rd year American Legion Post 208 has hosted sailors from Great Lakes Naval Training Center.
