Village of Bartlett Committee of the Whole met April 2. 

Here is the minutes as provided by the committee:

President Wallace called the Committee of the Whole meeting to order at 7:35 p.m.


PRESENT: Chairmen Camerer, Deyne, Gabrenya, Hopkins, Reinke and President Wallace

ABSENT:   Chairman Carbonaro

ALSO PRESENT: Village Administrator Paula Schumacher, Assistant Village Administrator Scott Skrycki, Senior Management Analyst Sam Hughes, Finance Director Todd Dowden, Planning and Development Services Director Roberta Grill, Public Works Director Dan Dinges, Public Works Engineer Bob Allen, Water Supervisor Tom Ruzicka, Management Analyst Tyler Isham, Building Director Brian Goralski, Head Golf Pro Phil Lenz, Chief Patrick Ullrich, Deputy Chief Chuck Snider, Village Attorney Bryan Mraz and Village Clerk Lorna Giless.

LICENSE & ORDINANCE, CHAIRMAN CAMERER

Carry-In License

Chairman Camerer stated that this evening we are discussing a carry–in license which would allow establishments to bring in alcoholic beverages, both wine and beer and asked staff to speak on the topic in a little more detail.

Senior Management Analyst Sam Hughes stated that staff received a request from a local restaurant about the possibility of this type of license. Staff looked into what some local communities that have a similar license do and developed the parameters that are in the sample ordinance for you. If a customer comes in with a carry-in beverage, they would be required to have a meal. If they do not finish their beverages, they are able to take any sealed cans or bottles with them. If they have a partially consumed bottle of wine, they can ask the licensee to properly bag it in a tamperproof, transparent bag and can legally take it out at that point. The licensees would be required to have dram shop or liquor liability insurance and a staff member who is basset trained would need to be onsite whenever carry-in was allowed. Additionally, the owner or licensee would need to go through a special use process if they wish to have wine or beer. If the site already has a special use for that, this process can be skipped. If the licensee already has a special use for outdoor seating, than this license will also allow them to have wine or beer on their patio in the fenced in area. The proposed cost of this license would be $250 which is in the range of surrounding communities that have a similar license.

Chairman Camerer stated that he thought $250 may be a bit much to ask a business owner that is providing a service to people coming in and are not really making any money off of it, to pay.

Mr. Hughes stated that the licensee has the ability to charge a corkage fee if they wish. It might range anywhere from $0 to $20 in our area.

Chairman Hopkins asked if we have a list of what other communities charge.

Mr. Hughes stated that Elgin, Geneva, Batavia and St. Charles all charge that $250 amount. President Wallace stated that it seemed to him that there has been a ton of research done on this and he has no issues with it.

Chairman Deyne stated that when he first saw it, he thought it was a great idea for the businesses.

Chairman Gabrenya asked if a business that already has a liquor license would be allowed to have a carry-license.

Mr. Hughes stated that it would not be held concurrently with any other license so it would be for a business that would not have a full liquor license, generally a small eatery that wants to remain competitive and allow patrons to bring in a bottle of wine at dinner.

President Wallace confirmed that you would not be able to receive this license if you already have a liquor license.

Village Attorney Mraz stated that was correct.

Chairman Gabrenya stated that in situations like this when they are not making revenue off alcohol and therefore not losing revenue if they lose this license, is there an increase in underage drinking in a situation such as this.

Mr. Hughes stated that Chief Ullrich did speak with the St. Charles Police Department and they haven’t had any issues with any of their carry-in establishments. The licensee is responsible for making sure no one is served underage or is overserved, they still hold that responsibility.

President Wallace stated that he noticed that they still have to go through Basset Training, so that’s good. He asked if anyone had any additional questions.

President Wallace stated that this item will be forwarded to the Board for final approval.

Trustee Deyne moved to adjourn and Trustee Hopkins seconded the motion.
