1. Consider a Resolution Granting a Two-Lot Subdivision at 1150 W. Wilson Street - Adopted by Voice Vote (Council District: One)

Planning & Zoning Director Ben Vyverberg presented a developer's request to subdivide a 1.36 acre parcel into 2 residential lots in the South Frog Hollow Sub Area. The Village Engineer has initially reviewed and conditionally accepted the engineering plans, noting the proposed subdivision conforms to all the minimum Zoning and Subdivision standards, Site Development, and Floodplain regulations. The Plan Commission unanimously approved the subdivision, and staff concurs.

B. POLICE POLICY & CODE SERVICES COMMITTEE – Time: 7:03 PM

1. Consider an Ordinance Granting a Special Use to Permit a Tobacco Shop at 1713 N. Rand Road #100 - Motion Carried by Voice Vote (Council District: Four)

Planning & Zoning Director Ben Vyverberg presented the petitioner's request for a Special Use to open a tobacco shop, selling tobacco, vape products and accessory items, within a multi-tenant building. Minors may not enter the premises unless accompanied by a parent or legal guardian. Vyverberg reviewed parking agreements. The ZBA voted unanimously to approve, and staff concurs.

2. Consider an Ordinance Granting a Variation for a Multi-Family Unit to be Less than the Minimum Required Square Feet to Allow an Existing Condominium Unit (#104) to be Divided Into Two Units at 140 W. Wood Street - Motion Carried by Voice Vote (Council District: Six)

Planning & Zoning Director Ben Vyverberg presented the petitioner's request to divide a two-bedroom unit into a one-bedroom unit and a studio unit, smaller than the minimum 500 square feet required by Ordinance. The Park Town HOA approved the conversion. Only one such unit remains that could be converted in this way. Parking is compliant. The ZBA voted unanimously to approve the variation and staff concurs.

In response to Councilman Solberg, Vyverberg stated the request does have to do with the HOA assessment.
