Motion was to approve Items A. and B.

Ben Vyverberg presented LPC's request for final approval of their 28.55 acre proposed development of a 367,696 square foot warehouse, distribution, or light manufacturing building, with associated parking and truck docks. Vyverberg outlined Conditions including the landscaping to screen residents to the northeast, parking, lighting, access and sidewalks. Tenants are required to be specific on approved use.

In response to Councilman Solberg, Vyverberg noted the developer is finalizing solid fencing and deferred to the developer.

Will Freve, Logistics Property Co. (LPC), 1 N. Wacker Drive, Chicago, stated the final design will be acceptable with homeowners. Both parties are working through the conditions of the building process and the fence, which will be determined by the HOA and contributed to by LPC.

Village Manager Reid Ottesen noted that the fence will be located in Schaumburg, not under our jurisdiction.

In response to Councilman Myslinski, the HOA will be receiving contributions from the developer, but will be responsible to maintain landscaping on HOA property.

The sidewalk on the south side of Algonquin was to aid employees of this business and businesses to the east.

Attorney Jonathan Pope, Elgin, and Will Freve, noted lighting on the north side of the facility will be on the drive side of the building, screened from residents to the north.

Councilman Solberg complimented the valuable input from residents in the area and invited their comments.

Sylvia Folage, College Hill, appreciated assistance from developer and staff. Vyverberg recommended approval of the Resolution for support for the filing of a 6b Cook County Tax Classification for the property located at 623 E. Algonquin Road.

1. Consider Award of Contracts for Watermain Replacement and Engineering Services

Motion was to approve Items A., B., and C.

Public Works Director Matt Barry recommended water main replacements on Harvard Court (from Illinois Avenue to the dead end) and Mallard Drive (from Illinois Avenue to Falmore Drive. This includes Pintail Court, Mallard Court, Tern Drive and Gull Court, including the cul-de-sacs connecting to Mallard Drive south of Illinois Avenue, using the lowest compliant bidder, Holiday Sewer and Water Construction, Inc. of Wauconda for $837,777.

Barry recommended water main replacements for Home Avenue (from Del Mar Drive to Thackeray), Ridge Trail (from Smith Street to the end of the cul-de-sac), Baldwin Road (from south of Inverrary Lane to Dundee), Gardenia Lane (from Old Hicks Road to Capri Drive), and Colfax Street (at Eric Drive), and awarding a contract to John Neri Construction Company, Incorporated of Addison, Illinois in the amount of $1,155,092.50.

Barry recommended awarding a contract for construction engineering to Doland Engineering for Construction Engineering Services for the 2022 Water Main Replacement Contract 2 and Contract 3 Projects in the not-to-exceed amount of $71,500.

C. POLICE POLICY & CODE SERVICES COMMITTEE – Time: 7:20 PM

1. Ordinance Amending Chapter 3 - Alcoholic Beverages - Motion Carried by Roll Call

Based on the March 14th Council discussion, Village Manager Reid Ottesen proposed amending Chapter 3 to adjust closing times of all restaurant/bars and other establishments with later closing times to 2 AM Thursday, Friday and Saturday evenings. He proposed adjusting hours on A, A-1, H and N licenses and eliminating the D-1 Liquor License and replacing it with a D License which would have a 1 AM closing Sunday-Wednesday and 2 AM closing Thursday-Saturday.

An additional classification, the Late Closing “LC” license, which exists for two grandfathered establishments: Durty Nellie’s and Gators, with the current closing time at 4 AM seven days per week would change to the Late Close hours of 2 AM on weekdays and 3:00 AM on weekends based upon draft ordinance.

Based on the March 14 Gaming discussion, staff research, and on monitoring neighboring communities, Ottesen proposed amending Chapter 3 to create a new “VG” Video Gaming Liquor License, noting that a change to State law allowing video gaming in fraternal organizations, brings video gaming to Palatine whether we like it or not. Ottesen prefers local control; therefore, he proposed the following perimeters for Video Gaming:

 must hold a D or N Liquor License;

 hours of operation same as liquor license;

 allow up to six terminals subject to an approved floor plan and terminal screening from the rest of the establishment;

 require that establishments are a liquor license holder in good standing with the Village at least for one year prior to application;

 prohibit any signage or anything depicting or advertising video gaming on the exterior of the establishment or anywhere on the inside that would be visible in any way from the outside;

 require video surveillance pursuant to State statute and include it to cover the exterior within 25 feet of entrances, 24-hour recording and make recordings available to Police;

 create a $1,000 per terminal fee plus the Class “VG” Liquor License fee recommended at $5,000.

One other significant provision of the “VG” Video Gaming liquor license is its automatic termination after 2 years unless the Council takes subsequent action. This “sunset” provision allows an opportunity to assess the impacts (positive and negative) that may result from this license. Village asks that proceeds be put back into the business and to insure there is no adverse impact on the health, safety, and welfare of Palatine.

Councilman Kozlowski thanked Ottesen and Staff for the extraordinary effort that went into this proposal and asked about having consistent village-wide close times for video gaming terminals. Ottesen stated the late close license doesn’t impact the end of gaming as the D license controls that. A 1 AM / 2 AM cut off for VG will be added to the motion, as approved by motion maker and seconder.

Discussion took place regarding different closing times for a late close license. An alternative language for Section 3 of the ordinance was presented and Ottesen explained it would provide for a 2 AM closing time in the downtown and a 3 AM closing time on Rand Road. Ottesen indicated that he talked to Nellies and the owner asked for 3 AM weekend (Friday, Saturday) close time through Labor Day Weekend, then to go to the 2 AM close license after Labor Day and thereafter. Village staff is agreeable. New hours to commence September 5, 2022.

Section 3 late close would need a substitute motion.

Councilman Helms recommended keeping the draft ordinance with 2 AM/3 AM close until the Video Gaming begins. If there are no issues, the 2 AM/3 AM close can be maintained.

Ottesen stated that the renewal of licenses would explain. All would go live July 1. Councilman Kozlowski opposes the draft ordinance, not applying village wide.

Councilman Lamerand supports the 1 AM/2 AM as consistent with intent, seeking consistency.

Councilman Myslinski supports 3 AM weekend close draft ordinance across the board.

Ottesen reiterated staff supports 3 AM weekend close through Labor Day, then a 2 AM weekend close in the downtown and 3 AM on Rand. Once a license is issued, it is for a year.

Councilman Helms again supported the late close continuing in the downtown, or at a minimum through Labor Day.

Councilman Millar noted that VG odds are listed between 80-100% and asked that the odds be displayed on or near the machines. Ottesen confirmed that the Village cannot dictate odds, but can require posting. Councilman Millar asked if odds are changeable daily or hourly. He opposes VG based on the referendum where residents opposed VG throughout the Village and overwhelmingly in his district.

Councilman Solberg stated $100 goes in, $74 comes out, according to state statistics.

Scott Mallack, the odds are established by the state for terminal operators to set across the board. Bars pay out higher than casinos.

Mayor Schwantz stated his opposition to gaming. The ordinance is very strict. He expressed his confidence in staff and business owners. He is going along with our health, safety and welfare officials. He noted the revenue component. Directing proceeds to go into capital improvements throughout the community. He asked if the business reinvestment can be tracked. Permitting costs will go to licensing and income will benefit all residents in Palatine. The sunset provision is our out if this does not go well.

Councilman Helms and Councilman Myslinski agreed to the Substitute

Motion: to amend Section 3 provide for a 3 AM close on weekends in Downtown for Durty Nellies through Labor Day. After Labor Day it would become a 2 AM close seven days a week. Rand Road establishments would continue current hours to July 1 and then have a 3 AM close.

The substitute motion was incorporated into the Amended Motion for roll call.

Ottesen stated the Amended Motion is noted in Paragraph B.

Finance Director Paul Mehring reported the 2021 4th Quarter Budget Adjustments are made up of: $12,287,312 - Budget Decrease, $5,354,768 - Budget Increase Using New Revenue Offsets, and $2,766,771 – Budget Increase Appropriating Reserves. With these changes, the total Village-wide 2021 budget will be decreased in the amount of $4,165,773. Staff recommends that the Village Council approve the 4th Quarter Budget Adjustments.

With these changes, the total Village-wide 2022 budget will be increased in the amount of $19,184,594. Staff recommends that the Village Council approve the 1st Quarter Budget Adjustments.
