Reduction at 632 E. Tahoe Trail - Motion Carried by Voice Vote

Planning & Zoning Director Ben Vyverberg explained the petitioner's request

for a Special Use to permit a front yard setback of 28’-6" instead of the

required 30'. The Zoning Board of Appeals voted unanimously to recommend

approval and staff concurs.

2. Consider an Ordinance Granting a Special Use for a Front Yard Setback

Reduction and Variation to Allow a Driveway Expansion at 144 S. Oak Street

- Motion Carried by Voice Vote

(Council District: Six)

Planning & Zoning Director Ben Vyverberg presented the petitioner's request

for a Special Use for a residential addition to be setback 11 feet instead of the

minimum required 30 feet, and a Variation to permit the driveway to be

setback 1 foot from the interior side lot line instead of the minimum required 2

feet. Village Engineer and the Zoning Board of Appeals recommend

approval.

In response to Councilman Millar's concern that the petitioner's plan may not

solve the flooding problem, Vyverberg confirmed that staff reviewed the

topographical study for storm water flooding.

Councilman Myslinski asked about the garage doors and fill to bring garage

up to grade and redirect the storm water drainage.

Carol Pirog, petitioner, 144 S. Oak Street, provided photos of the flooding of

the front yard and stated that the back yard does not flood. She stated that

four sump pumps cannot handle the storm water in a heavy rain; the storm

sewers are full and water comes from the north end of Oak Street.

Village Manager Reid Ottesen explained the advantages of the petitioner's

request.

Planning & Zoning Director Ben Vyverberg presented the petitioner's request

for a Special Use to permit a sushi restaurant in the Eurofresh Plaza where

parking exceeds the minimum requirement. The Zoning Board of Appeal

unanimously recommended approval and staff concurs.

Planning & Zoning Director Ben Vyverberg explained Wajo Sushi's request for

a Class G Liquor License (restaurant with beer and wine), requiring an

Ordinance to increase the number of the Class G Liquor Licenses by one with

an annual fee of $2,209.

Planning & Zoning Director Ben Vyverberg presented the petitioner's plan to

purchase T.J. O’Brien’s and request for a transfer of Special Use #0-205-07,

as amended, to permit its continued operation. The Subject Property was

originally Mint Julep Bistro in 2007, Hot Shots in 2010 and T.J. O’Brien’s in

2015. With compliance with the Village designated smoking area near the

tracks, staff recommends approval.

Jennifer Brey, petitioner, was present and agreed to conditions.

Planning & Zoning Director Ben Vyverberg reviewed the proposed

amendments to various sections of the Village's Zoning Ordinance

regarding Planned Development regulations and the scope of Administrative Special Uses and Variations including types of eligible

relief, setbacks, lot coverage, fencing, non-conforming structures, staff

review, sign off, 250 feet notifications, and other amendments.

Councilman Helms suggested increasing the 250 feet notification radius

for larger projects.

Councilman Solberg questioned the administrative review for project

approval.

Councilman Millar questioned front yard and second story additions and

phone complaints as well as written complaints.

Village Manager Reid Ottesen stated this is an attempt to be more user

friendly yet still have oversight on additions. Phone in complaints must be

put in writing to avoid incorrect interpretation.

The motion was to approve items A and B.

Replace the Combined Service Facility Roof Top HVAC Units - Approved by

Public Works Director Matt Barry explained the need for replacement of the

26 year old rooftop HVAC units on the Combined Service Facility. The Trane

U.S., Inc. of Willowbrook, Illinois, proposal for $209,752 includes a Tracer SC

web-based control system, which has the ability to send alarms to a

smartphone and slows for off-site control. Staff recommends approval.

RESULT: APPROVED BY VOICE VOTE [UNANIMOUS]

Public Works Director Matt Barry outlined the existing Agreement of

Understanding with the Illinois Department of Transportation (IDOT) for

maintenance of Village streets using Motor Fuel Tax proceeds. Barry

recommended updating the Agreement to reflect uniformity within the various

regions of IDOT, and to authorize the Mayor to execute the Agreement of

Understanding with IDOT.

Public Works Director Matt Barry recommended the adoption of an Ordinance

authorizing the Village Manager to dispose of, through internet auctions, the

excess vehicles and equipment including five sedans, one branch chipper,

one tractor/loader, two dump trucks, one skid steer, one street sweeper, one

chipper truck, and one pickup truck.
